Refund policy
REFUNDS, RETURNS & CLAIMS POLICY
1. Business-to-Business Supply
TECHEX INDIA primarily supplies fabrics to apparel brands, manufacturers, sourcing teams, product developers and other commercial buyers. All orders are subject to written confirmation of the fabric, colour, quantity, specifications, price, payment terms and delivery conditions.
2. Mandatory Lot-Sample Approval
Every commercial order will be dispatched only after the buyer has approved a lot sample taken from the actual production or supply lot.
The lot sample may be shared physically, digitally or through another mutually agreed method. Dispatch will begin only after written approval is received through email, WhatsApp, purchase order confirmation or another recorded communication.
Approval of the lot sample confirms the buyer’s acceptance of the approved lot’s:
- Colour and shade
- Surface appearance
- Texture and hand feel
- Finish and coating
- Construction
- Stretch and recovery
- Drape and lustre
- GSM, width and other specifications within the agreed commercial tolerances
The buyer must conduct all necessary testing and evaluation before providing approval.
3. Finality of Lot Approval
Once the buyer approves the lot sample, the approval will be considered final for all characteristics that were visible, measurable or reasonably capable of being evaluated from the approved sample.
After approval, TECHEX INDIA will not entertain returns, refunds, cancellations, price reductions or claims based on:
- Shade, texture or hand-feel preferences
- Drape, sheen or surface appearance
- Buyer change of mind
- Unsuitability for an application not disclosed before ordering
- Differences from website photographs or digital screens
- Differences already visible in the approved lot sample
- Commercially acceptable variation within the tolerances confirmed in the quotation or order confirmation
- Buyer’s failure to test the lot sample before approval
4. No Cancellation After Approval
After the lot sample has been approved and dispatch, cutting, packing, production or customization has commenced, the order cannot be cancelled.
Any advance payment or amount paid against such an order will be non-refundable, except where TECHEX INDIA agrees otherwise in writing.
5. No Returns or Refunds After Dispatch
Approved fabric orders, cut-length materials, customized fabrics, specially sourced products, custom colours and commercially produced lots are not returnable or refundable after dispatch.
Material cannot be returned merely because the buyer’s customer, manufacturer, designer or production team later rejects the fabric for reasons already covered by the approved lot sample.
6. No Claims After Cutting or Processing
The buyer must inspect the complete fabric shipment before:
- Cutting
- Stitching
- Washing
- Dyeing
- Printing
- Embroidery
- Lamination
- Coating
- Bonding
- Heat treatment
- Garment production
- Any other form of processing or conversion
No claim will be entertained after the material has been cut, processed, altered, used or transferred to production.
Use or processing of any part of the shipment will be treated as acceptance of the supplied lot, except for a proven latent manufacturing defect that could not reasonably have been identified before processing and is accepted by TECHEX INDIA after inspection.
7. Limited Circumstances in Which a Claim May Be Reviewed
Despite lot-sample approval, TECHEX INDIA may review a claim only where the buyer provides evidence of:
- Supply of an incorrect fabric or colour compared with the written order confirmation
- A material shortage compared with the invoiced quantity
- Visible transit damage recorded at the time of delivery
- A substantial deviation from the approved lot sample or written specifications
- A latent manufacturing defect that could not reasonably have been detected from the approved sample
- Any matter that cannot legally be excluded
Approval of the lot sample does not automatically establish that a later claim is valid.
8. Claim-Reporting Period
Claims relating to incorrect supply, visible damage, shortage or visible non-conformity must be submitted in writing within three working days of delivery.
Claims relating to an alleged latent manufacturing defect must be submitted within seven calendar days of delivery, before the material is cut, processed or converted.
Claims submitted after these periods may be rejected.
9. Required Claim Evidence
Every claim must include:
- Invoice number
- Purchase-order or order-confirmation reference
- Fabric name and colour
- Lot or batch number
- Quantity allegedly affected
- Clear photographs and videos
- Measurement or testing records, where relevant
- Photographs of the packaging and transport documents
- A representative uncut sample from the affected lot
- Written details explaining the alleged non-conformity
The buyer must preserve the complete allegedly affected material in its original, unused condition until TECHEX INDIA has reviewed the claim.
Failure to provide sufficient evidence may result in rejection of the claim.
10. Inspection and Resolution
TECHEX INDIA may request:
- Physical inspection of the material
- Return of an uncut representative sample
- Independent testing
- Lot and production records
- Access to the allegedly affected goods
If a claim is accepted, the remedy will be determined by TECHEX INDIA and may include:
- Replacement of the proven affected quantity
- Credit adjustment
- Repair or reprocessing, where commercially possible
- Refund limited to the proven affected quantity
No refund, replacement or credit will be issued before the claim has been verified.
11. Limitation of Liability
To the extent permitted by applicable law, TECHEX INDIA will not be responsible for indirect or consequential losses, including:
- Loss of profit
- Loss of business
- Production delays
- Garment rejection
- Labour or processing charges
- Penalties imposed by the buyer’s customer
- Marketing or reputational losses
- Losses caused by using the fabric before inspection
Any accepted liability will be limited to the value of the proven affected fabric quantity, unless otherwise agreed in writing.
12. Order-Specific Terms
The quotation, proforma invoice, approved lot sample, purchase order and written order confirmation form part of the commercial agreement.
Where an order confirmation contains specific claim periods, tolerances or conditions, those order-specific terms will prevail over this general policy.
